Criminal record checks

Under the Sports Act and the Youth Act, organisations covered by the acts that work with children and young people under 18 in sports may not employ individuals who have been convicted of offences under Chapter XXII of the General Penal Code, or who have been convicted of offences under the Narcotics Act in the past 5 years. The Sports Act also specifically states that the same applies to individuals convicted of offences under Article 211 or Article 218 of the General Penal Code. This also applies to those entrusted with the care of children and young people under 18 as volunteers.

Sports clubs are legally entitled to obtain information from the criminal record on the above offences for people they employ, as well as volunteers who are to work with children and young people.

The information must be obtained directly from the Director of Public Prosecutions with the consent of the person concerned.

The Communication Advisor has prepared both guidelines and forms on how to obtain this information. The material is available both on the Communication Advisor’s website and below.
